Le dépositaire central joue un rôle fondamental dans le bon fonctionnement des marchés financiers, en assurant la conservation, la compensation et le règlement des titres financiers. En tant qu'infrastructure clé du marché, il garantit la sécurité et l'efficacité des transactions, ainsi que la transparence des échanges entre les différents acteurs économiques.

Ce recueil réglementaire a pour objectif de fournir un cadre clair et précis concernant les responsabilités, les obligations et les droits des participants au système du dépositaire central. Il s'appuie sur les législations nationales :

En référence a Article 10 de la loi N° 35-96 « relative à la création d’un dépositaire central et a l’institution d’un régime général de l’inscription en compte de certaines valeurs » :

Seuls peuvent être affiliés du Dépositaire central :

› les intermédiaires financiers visés au c) de l'article premier ci-dessus et habilités conformément aux dispositions de l'article 24 de la loi N° 35-96 ;

› les personnes morales émettrices de l'une des valeurs visées au 1er alinéa de l'article 19 ou à l'article 20 de la loi N° 35-96 ;

› les organismes étrangers ayant un objet similaire à celui du Dépositaire central précité.
